This is a translation of the Portuguese privacy policy, provided for convenience. In case of any discrepancy, the Portuguese version prevails.
This policy explains how we process the personal data collected through this website, in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”) and Portuguese Law No. 58/2019 of 8 August, which implements it in Portugal.
1. Data controller
EMG Som & Imagem de Carlos Jorge A. M. Godinho, VAT number (NIF) 204428378, with registered address at Rua Major Joaquim Sérgio, 22, 2460-153 Alfeizerão, Portugal, is the controller of the personal data collected through this website.
For any privacy question or to exercise your rights, contact us at geral@emg.com.pt, by phone on +351 914 106 166 (charged as a call to a Portuguese mobile network) or by post at the address above. We have not appointed a data protection officer, as we are not required to do so (Article 37 GDPR).
2. What data we process
- Quote requests: name, company, email, phone number and project description.
- RMA (technical support) requests: name, company, VAT number, email, phone number, collection or return address, equipment details (brand, model, serial number, invoice date and number, warranty, accessories) and description of the fault.
- Direct contact: the data you send us by email or phone.
- Technical data: when you visit the website, your browser sends your IP address and technical information (browser type, date and time of access) to the server hosting the website. This data is used only to deliver the pages and keep the service secure. All website content, including fonts, is served from our own hosting, with no requests to third-party services while you browse.
We do not ask for, and do not wish to receive, sensitive data (for example, about health or political opinions). Please do not include it in your messages.
3. Purposes and legal bases
- Answering enquiries and preparing quotes: steps taken at your request before entering into a contract (Article 6(1)(b) GDPR).
- Handling technical support, warranty and repair requests: performance of a contract and compliance with the legal warranty obligations for consumer goods (Article 6(1)(b) and (c) GDPR; Portuguese Decree-Law No. 84/2021 of 18 October).
- Invoicing, accounting and tax obligations: compliance with legal obligations (Article 6(1)(c) GDPR).
- Operating and securing the website, including preventing automated (spam) form submissions: our legitimate interest in keeping the website available and secure (Article 6(1)(f) GDPR).
Form fields marked with * are required for us to handle your request; without them we cannot reply. We do not use your data for marketing, we do not sell it, and we do not make automated decisions or carry out profiling (Article 22 GDPR).
4. Who we share data with
We share data only to the extent needed for each purpose:
- Formspree, Inc. (United States): receives the messages sent through the website forms and forwards them to our email, acting as a processor on our behalf. If a form is submitted with JavaScript disabled, Formspree may show an anti-spam check (Google reCAPTCHA).
- Email and website hosting providers, acting as processors on our behalf.
- Equipment manufacturers and distributors, when needed to process a warranty claim or repair.
- Courier companies, to collect and deliver equipment.
- Public authorities, where required by law.
5. Transfers outside the European Economic Area
Formspree is based in the United States, as is Google for the anti-spam check mentioned in section 4. Transfers of data to these entities are based on the European Commission's adequacy decision on the EU-U.S. Data Privacy Framework (Implementing Decision (EU) 2023/1795), where the recipient is certified, or on the standard contractual clauses approved by the European Commission (Implementing Decision (EU) 2021/914). You can ask us for more information about these safeguards using the contact details in section 1.
6. How long we keep data
- Quote requests that do not lead to a contract: up to 2 years after the last contact.
- Technical support requests and repairs: for the warranty period of the equipment and of the repair and, after that, for as long as needed to respond to any claims.
- Invoicing and accounting documents: for the legal retention period (currently 10 years).
- Messages on the Formspree platform: only for as long as needed for them to reach our email and be handled.
- Technical access data: for the retention period set by the hosting provider for security purposes.
At the end of these periods, the data is deleted or anonymised.
7. Cookies
This website does not use cookies or store information on your device, and does not use analytics or advertising tools. For this reason we do not ask for your consent to cookies (Portuguese Law No. 41/2004 of 18 August). If this changes, we will update this policy and ask for your consent before using any cookies that are not strictly necessary.
8. Your rights
Under Articles 15 to 21 GDPR, you have the right to:
- access your data and obtain a copy;
- have inaccurate or incomplete data corrected;
- have your data erased when it is no longer needed or there is no legal basis for processing it;
- restrict processing;
- receive the data you provided to us in a structured, commonly used format (portability);
- object to processing based on our legitimate interest.
To exercise these rights, contact us using the details in section 1. Requests are free of charge and we reply within one month, which may be extended by two further months for complex requests, in which case we will let you know (Article 12 GDPR). We may ask you to confirm your identity.
9. Complaints to the supervisory authority
If you believe your data is not being processed lawfully, you can lodge a complaint with the Portuguese data protection authority, Comissão Nacional de Proteção de Dados (CNPD), Av. D. Carlos I, 134, 1.º, 1200-651 Lisboa, Portugal, www.cnpd.pt, or with the supervisory authority of the EU country where you live or work.
10. Children
This website is intended for businesses and adult customers and does not knowingly collect data from children under 13 (Article 16 of Law No. 58/2019). If you become aware that a child has sent us personal data, please contact us so that we can delete it.
11. Security
We take appropriate technical and organisational measures to protect data against destruction, loss, alteration, disclosure or unauthorised access, including sending form data over an encrypted connection (HTTPS) and restricting access to the people who need the data to handle your request.
12. Complaints Book and alternative dispute resolution
You can file a complaint in the Portuguese electronic Complaints Book (Livro de Reclamações Eletrónico).
In the event of a consumer dispute, consumers may refer it to an alternative consumer dispute resolution body (Portuguese Law No. 144/2015 of 8 September), namely CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt). The full list of bodies is available on the Portuguese Consumer Portal (www.consumidor.gov.pt).
13. Changes to this policy
We may update this policy to reflect changes to the website or the law. The current version is always published on this page.
